Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of EcomSanity ("Service"), operated by Sandalsoft Bilişim Ltd. Şti. ("Company," "we," "our," or "us"). By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

EcomSanity is a service that connects to Amazon Seller Central via the official Selling Partner API (SP-API) to provide:

  • Real-time sales metrics and performance tracking
  • Order synchronization and management
  • Compliant review request functionality
  • Analytics and reporting features

The Service requires you to have an active Amazon Seller Central account and to authorize our application to access your seller data through Amazon's SP-API.

3. Eligibility and Account Registration

To use the Service, you must:

  • Be at least 18 years old
  • Have a valid Amazon Seller Central account
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be responsible for all activities under your account

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Amazon SP-API and Seller Central Connection

Our Service integrates with Amazon Seller Central through Amazon's official Selling Partner API (SP-API). By connecting your account:

  • You authorize us to access your Amazon seller data through SP-API
  • You understand that we will only access data necessary for Service functionality
  • You agree to comply with Amazon's policies, including the Solution Provider Agreement
  • You acknowledge that your use of our Service must comply with Amazon's Acceptable Use Policy
  • You understand that Amazon may revoke API access at any time per their policies

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws or regulations
  • Violate Amazon's policies, including the Acceptable Use Policy and Solution Provider Agreement
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use the Service to send spam, unsolicited messages, or non-compliant review requests
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems to access the Service without authorization
  • Share your account credentials with others
  • Use the Service in a manner that could damage, disable, or impair our systems

6. Compliance with Amazon Policies

Your use of the Service must comply with all applicable Amazon policies, including but not limited to:

  • Amazon's Acceptable Use Policy
  • Amazon's Data Protection Policy (DPP)
  • Amazon's Solution Provider Agreement
  • Amazon's Review Request Guidelines
  • All applicable regional regulations and laws

We reserve the right to suspend or terminate your access if we determine that your use violates Amazon policies or these Terms.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Sandalsoft Bilişim Ltd. Şti. and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not use our trademarks, logos, or other proprietary information without our express written consent. The EcomSanity name and logo are trademarks of Sandalsoft Bilişim Ltd. Şti.

You retain all rights to your Amazon seller data. We do not claim ownership of your data, but you grant us a license to use, store, and process your data as necessary to provide the Service.

8. Pricing and Payment

Please refer to our Pricing page for current pricing information. We reserve the right to modify our pricing at any time. Changes to pricing will be communicated to existing users with reasonable notice.

If you are on a paid plan, you agree to pay all fees associated with your subscription. Fees are charged in advance on a recurring basis. You are responsible for providing valid payment information.

9. Service Availability and Modifications

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not guarantee the accuracy, completeness, or usefulness of any information provided through the Service.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Sandalsoft Bilişim Ltd. Şti. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of another party.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms or violate Amazon policies.

You may terminate your account at any time by contacting us at brock@sandaldata.com. Upon termination, your right to use the Service will cease immediately, and we will delete your data in accordance with our Privacy Policy.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Kocaeli, Turkey.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
